Registration of trademark protection in Vietnam

Brand name you want to register for protection in the National Office of Intellectual Property of Vietnam must not be identical or confusingly similar to a trademark / brand name has been registered before. The process of registration of trademark protection(đăng ký bảo hộ nhãn hiệu) in Vietnam:
1 Receipt of application: Apply trademark registration at the Intellectual Property Department facility;
2 Evaluation of application form: Within 01 months from the date of filing, checking compliance with the regulations for the application form, from which conclusions can be considered the application is valid or not.
a) issue notices to accept / deny approval of the application:
· In case of valid application, the Intellectual Property Department will issue a notice of acceptance of the application;
· In case of invalid applications, the Department will issue a notice of refusal to accept the application.
3 Disclosure application: within 02 months from the date of acceptance of the valid application; Applications will be considered valid will be published in the Official Gazette of industrial property.
4 Examining the content of the application: within 9 to 12 months from the date the application for registration of trademark protection to be announced. Evaluate the ability of the protected object in the application according to the conditions of protection, and to determine the scope of protection respectively.
a) Decision to grant / refuse to grant a protection title:
· If the object stated in the application does not meet the requirements for protection of Intellectual Property Department will issue a decision refusing to grant a protection title;
· If the object described in the application meets the requirements of the protection of, and the applicant shall pay the full cost of Intellectual Property Department will issue a decision granting protection, recorded in the national register industrial property, and published in the Official Journal of Intellectual Property.
